These Terms govern your purchase and use of BandStack (“the Software”), a desktop application for Windows made by the BandStack team, based in Argentina (“BandStack”, “we”, “us”). These Terms are the End User License Agreement for BandStack. By purchasing, downloading or using BandStack, you agree to these Terms.
1. Purchase and payment
BandStack is sold through Polar, which acts as our online reseller and Merchant of Record. Polar processes your payment, issues your receipt and handles applicable sales taxes. The purchase itself is governed by Polar’s Buyer Terms; your use of the Software is governed by these Terms. The price shown on our website is a one-time payment. There is no subscription and no recurring charge. If something is wrong with your order, please contact us so we can help resolve it. This does not restrict your statutory rights or rights under the payment provider’s terms.
2. License
When you buy BandStack, you receive a personal, non-exclusive, non-transferable, lifetime license to install and use the Software on up to 2 computers that you own or control, with one license key. You may deactivate a computer to move your license to a new one. The license is for you or your band; you may not resell, rent, sublicense or share your license key.
3. Activation and license checks
BandStack requires an internet connection to activate your license key. After activation, the app checks the license with Polar periodically. You can use the app offline, but if it cannot verify the license for an extended period (currently 30 days), it will ask you to connect to the internet again. Refunded or revoked licenses are no longer valid and stop being accepted when their status is checked.
4. Updates
Your purchase includes free updates to the BandStack Windows app. Updates are delivered automatically through the app. Separate future products or services (for example, an online resource library or a community space) may have their own terms and prices, which will be announced separately.
5. Your content and data
Your content remains yours. BandStack stores your band’s workspace data (contacts, shows, finances, images, videos, lyrics and other files) locally on your computer, rather than uploading that workspace to us. Requests made by connected features are described in our Privacy Policy. You are responsible for keeping backups; BandStack includes backup tools for this.
6. Third-party content you use
You are responsible for having the rights to the music, images, fonts, logos and other material you import into BandStack or publish with it. The styles, templates and sample media included with BandStack may be used to create your own content, including commercial content for your band, but may not be resold or redistributed as standalone files.
BandStack also includes open-source components (such as FFmpeg) and open data (such as GeoNames and OpenStreetMap), which are provided under their own licenses. Those licenses continue to apply to the respective components and data. You can see the full list, with each license, in the app under Settings → Third-party licenses.
7. Acceptable use
You may not copy, modify, decompile, reverse engineer or redistribute the Software, or remove or bypass its license protection, except where the law or an applicable open-source license expressly allows it.
8. Disclaimer
BandStack is provided “as is”. We work hard to make it reliable, but we do not guarantee that it will be error-free or uninterrupted, or that it will meet every need. To the maximum extent permitted by law, we disclaim all implied warranties. Nothing in these Terms excludes any guarantee or right that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages, or for loss of data, profits or business, arising from your use of BandStack. Our total liability is limited to the amount you paid for the Software. These limitations do not apply where prohibited by applicable law.
10. Refunds
Refunds are covered by our Refund Policy, together with Polar’s Buyer Terms and your mandatory consumer rights.
11. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, with its date. Changes will not reduce the rights you already have for a purchase you made.
12. Governing law
These Terms are governed by the laws of the Argentine Republic, without prejudice to any mandatory consumer protection rights you have in your country of residence.
